摘要
国家公园确权登记是将地理空间范围上的国家公园整体作为统一的“超级登记单元”而展开的空间确权登记,其蕴含了使登记客体呈现生态性革新和空间性扩张的新趋势。因而,国家公园确权登记与传统上以资源要素(宗地、宗海等)为对象的权属性物权登记间存在较大非适应性。有必要通过重释支撑国家公园确权登记改革的“空间治理”和“生态文明”双线逻辑;确立不同于“豁免登记”的国家所有权强制性登记规则;建立适应于“超级登记单元”的“总登记—分登记”格局;明确管制性事项的登记能力及其在登记簿中具体设置等举措,完善国家公园确权登记制度,以适应生态文明法治建设的绿色登记新要求。
The registration of national park rights is the registration of space rights that takes the whole national park in geographical space as a unified"super registration unit",It contains the new trend of ecological innovation and spatial expansion of registration object.Therefore,There is great inadaptability between the registration of national park right and the registration of property right attribute which traditionally takes resource elements(land parcel,sea property,etc.)as the object.It is necessary to reinterpret the dual logic of"spatial governance"and"ecological civilization"that supports the reform of the registration of national park rights.Establishing rules for the compulsory registration of state ownership,which are different from"exemption registration";To establish a"general registration-sub-registration"pattern suitable for"super registration units";Clarifying the registration capacity of controlled sexual matters and its specific setting in the register,improve the confirmation and registration system of national park rights,In order to adapt to the ecological civilization of the rule of law construction of green registration new requirements.
