摘要
外嫁女参与集体收益分配纠纷的实质是作为政治自由的村民自治与外嫁女的平等权冲突,对该类案件的裁判涉及宪法和法律中的平等规范与村民自治规范的适用。在规范援引方式上,法院有三种选择:援引宪法中的平等规范、援引法律中的平等规范和村民自治规范,以及同时援引宪法中的平等规范、法律中的平等规范和村民自治规范。平等是外嫁女参与收益分配案件的重点审查问题,涉及审查框架;村民自治是审查过程中必须处理的另一个问题,涉及审查基准。在援引其他规范能够处理外嫁女参与集体收益分配纠纷时,法院也会“便宜”地选择适用其他规范。法院裁判这类纠纷时,注意村民自治和外嫁女平等权之间的微妙平衡,但基于男女在集体收益分配事实上的不平等,法院更强调平等作为村民自治的边界。
The essence of disputes over the distribution of income of out-married women participating in collective economic organizations is the conflict between autonomy of villagers as political freedom and the equal rights of out-married women,the adjudication of such cases involves the application of equality norms and villager autonomy norms in the Constitution and the laws.In the way of invoking norms,the courts has three choices:invoking the equality norms in the Constitution,invoking the equality norms and villager autonomy norms in the laws,and invoking both the equality norms in the Constitution and the equality norms and villager autonomy norms in the laws.Equality is the key review issue of out-married women’s participation in income distribution cases,which involves the review framework,and villager autonomy is another issue that must be dealt with during the review process,which involves review benchmarks.When other norms can be invoked to deal with disputes over the participation of out-married women in collective income distribution,the courts will also“conveniently”choose other norms.In adjudicating such disputes,the courts should pay attention to the delicate balance between the autonomy of villagers and the equality rights of out-married women,but based on the actual inequality between men and women in the distribution of collective income,the courts emphasize equality as the boundary of villagers’autonomy.
