摘要
农村宅基地使用权继承因上位法源缺失而难以在实践中得以合理运作,症结在于宅基地使用权具备复杂的法律属性,在内部存在财产流转和生存保障、居住管理功能的博弈,在外部又有宅基地公有性和地上房屋私有性的冲突。但除却政策支持,就现行法律而言,构建宅基地使用权继承规则并非无路可走,只需明确宅基地使用人为自然人、宅基地使用权的继承性及继承时的去身份,加以期限、“一户一宅”原则的限制,并引入法定租赁权补充,即能达到继承人个人利益与村集体经济组织公共利益平衡之效果,并促进土地流转和利用,为农村宅基地制度改革先行探路,促进农村土地制度上的乡村振兴。
The inheritance of the right to use rural homesteads is difficult to operate reasonably in practice due to the lack of superior legal sources.The crux of the problem lies in the complex legal attributes of the right to use homestead land,the internal game of property circulation,survival security,and residential management functions,and the external conflict between the public ownership of homestead land and the private ownership of houses on the ground.However,in addition to policy support,as far as the current law is concerned,it is not impossible to establish rules on the inheritance of the right to use homesteads.On one hand,it is only necessary to clarify the homestead user as a natural person,as well as the inheritance of the homestead use right and the identity at the time of inheritance.On the other hand,the time limit and the principle of"one household and one house"are supposed to be imposed on.What’s more,the supplementation of statutory lease rights should be introduced.In this way,the following effects could be achieved.Firstly,it is conducive to keeping the balance between the personal interests of the heirs and the public interests of the village collective economic organizations.Secondly,the circulation and utilization of land could be promoted.Lastly,the way for the reform of the rural homestead system can be explored,which will facilitate the revitalization of the rural areas in the rural land system.
