摘要
现行农村宅基地制度存在诸多的问题,如农民宅基地使用权容易被侵害、农民无法通过宅基地使用权融资、宅基地被闲置、"小产权"房纠纷不断、扩大城乡差别等。宅基地的私有化或国有化都是与现行法律相悖的,也是难以推行的,而借鉴宅基地法定租赁权制度改革我国的农村宅基地制度是一种明智的选择。宅基地法定租赁权制度的核心是在集体经济组织、农民和农房买受人之间形成三方权利义务关系,既有利于宅基地使用价值的充分实现,又便于城乡之间的经济流通与互补。
There are many problems and defects in the present homestead system in rural area, Such as: the peasant's right to the homestead land is liable to be infringed; peasants cannot borrow money through the right of homestead ; many homestead lands are leaved unused; creating ownership disputes; expanding the difference between the urban and rural areas; etc. The attempt to pursue privatization or nationalization in the homestead system is incompatible to the current law and policy. However, it could be a wise choice to draw lessons from the system of statutory tenancy for the reform of current homestead land system. The core of the statutory tenancy is to establish a new tripartite legal relationship among the peasant, the collective economic organization and the buyer of peasant's house. The suggested new system is beneficial to the realization of the value of the homestead land, and, moreover, to the economic circulation and mutual beneficial between town and country.
