摘要
《长江保护法》实施以后,长江流域各省在环境司法保护工作上有了一系列新发展和新举措,包括对流域环境司法体制和司法权运行机制的探索等。但长江流域环境司法在理念上、体制机制上以及审判实务上仍面临着亟待解决的问题,长江流域环境司法理念的转变,相关体制机制的完善,审判指导的规范化成为必然要求。设立长江生态法院虽然还面临一些障碍和困难,却是长江生态环境司法保护的现实需要,对其进行理论探索和实践证成有助于理顺长江流域环境司法保护的体制机制,进一步加强长江大保护的司法合力。
After the implementation of the Yangtze River Protection Law,the provinces in the Yangtze River Basin have made a series of new developments and measures in environmental judicial protection,including the exploration of environmental justice system and the operation mechanism of judicial power in the basin.However,environmental justice in the Yangtze River Basin still faces urgent problems to be solved in terms of concept,system and mechanism,judicial practice,and the transformation of environmental judicature concept in the Yangtze River Basin,the improvement of relevant system and mechanism,and the standardization of judicial guidance have become inevitable requirements.Although the establishment of the Ecological Court of the Yangtze River still faces some obstacles and difficulties,it is a practical need for the judicial protection of the ecological environment of the Yangtze River,and its theoretical exploration and practical evidence will help straighten out the system and mechanism of environmental judicial protection in the Yangtze River basin and further strengthen the judicial force of the great protection of the Yangtze River.
