摘要
为了全面加强环境资源审判工作,我国需要将传统的民事、行政、刑事审判制度有机结合起来,实行环境司法"三审合一"。"三审合一"有利于统一环境资源案件的裁判尺度,实现环境资源案件的优质高效审理,维护环境资源案件当事人的权益,对环境资源形成全方位、综合性的立体司法保护。这一审理模式在我国司法实践中已取得了较大进展,同时存在一些深层次问题,如诉讼程序的实质整合程度有待提高,案件审理的合法性与专业性不足,判决的适当履行存在困难等。为了完善环境司法"三审合一"模式,需要积极探索环境资源案件分类审理程序,合理设置环境资源专门审判机构,建立健全适应环境资源审判需要的法官队伍和专家队伍。
In order to comprehensively strengthen the environmental resources trial, China should implement the ＂ Unity of Three Traditional Trial＂ in the environment justice, including the traditional civil, criminal investigation and justice system. ＂Unity of Three Traditional Trial＂ has some advantages for the environmental resources cases, such as the unification of judgment standard, the realiza- tion of high quality and efficiency trial, the maintenance of the rights and interests of the parties concerned, the judicial protection of environmental resources. This trail mode has achieved great progress in the judicial practice in China while there also exhibit some deep-rooted problems, the substantial integration o＇i＂ environmental litigation procedures, legitimacy and professionalism of the trail, ap- propriate execution of the judgment, and so on. The Perfection of ＂Unity of Three Traditional Trial＂ of the environmental judicial needs to explore the classifying trail procedure, reasonably set up the special trail institutions, establish and perfect the team of judges and experts.
