行政处罚权下放乡镇街道的现实困境与应对

摘要 2021年《行政处罚法》修订,其新增的第24条意味着乡镇街道综合执法被正式纳入到我国法律框架当中。而在行政处罚权下放至乡镇街道的实践过程中,存在着执法权限划转不当导致制度异化、执法衔接不畅引发执法效率低下以及执法监督缺位造成执法质量不佳等现实困境。对此,首先需要明确“交由”赋权的规范意旨及法律性质,以此为导向,进一步明确规范层面行政处罚权下放的事项内容与授权程序标准,完善具体运行层面的乡镇街道行政执法机制,从明晰上下级执法职权边界、优化执法资源配置以及落实行政授权事后监督调整三个方面做出应对,构建起协调高效的基层综合行政执法体系。 In 2021,the Administrative Penalty Law was revised,with the addition of Article 24,which officially incorporated the comprehensive law enforcement of towns and streets into China s legal framework.While in the practical process of delegating administrative penalty power to towns and streets,there are realistic dilemma such as institutional alienation led by improper division of law enforcement authority,low law enforcement efficiency led by blocked connection of law enforcement and poor law enforcement quality led by omission of law enforcement supenision.improper division of law enforcement authority leading to institutional alienation,blocked connection of law enforcement leading to low law enforcement efficiency,and omission of law enforcement supervision leading to poor law enforcement quality.In this regard,it is necessary to clear the normative intent and legal nature of the“delegation”of power in the first.Guided by this,we should further clarify the content and authorization procedure standards of administrative penalty power delegation at the normative level,improve the town and street administrative law enforcement mechanisms at the specific operational level,and respond from three aspects:clarifying the boundaries of law enforcement powers between superiors and inferiors,optimizing the allocation of law enforcement resources,and implementing the post supervision and adjustment of administrative authorization.Then we can establish a coordinated and efficient grassroots comprehensive administrative law enforcement system.
