摘要
中国与泰国经贸关系日益密切,但泰国对华反倾销案件频发,严重影响中泰全面战略合作伙伴关系和中泰命运共同体构建,以及中国与东盟其他成员国乃至整个东盟的经贸关系。分析泰国对华反倾销问题对于在中国—东盟自贸区乃至RCEP框架下寻求反倾销问题解决方案具有重要意义。基于1995—2021年泰国对华反倾销的30起案件(未含泰国针对我国香港、澳门、台湾地区的案件),对泰国对华反倾销的现状、原因进行分析。研究发现:我国已经成为泰国反倾销的首要对象国;钢铁行业及其制品是泰国对华反倾销案件涉及最多的行业与产品;泰国对华反倾销执行率和税率较高;新冠疫情背景下泰国对华反倾销案件数量逆势增加,但大多被实施暂停征税措施。泰国对华反倾销频发的主要原因:一是泰国长期实施贸易保护政策,以推动工业化进程和摆脱中等收入陷阱;二是我国为泰国第一大进口来源国,且中泰贸易模式日益转向产业内贸易;三是钢铁产业是泰国着力保护的比较劣势产业,而我国是泰国进口钢铁制品的主要来源国;四是我国企业忽视了对价格承诺这一应诉反倾销有效措施的利用,导致泰国对华反倾销执行率居高不下;五是我国对泰国反倾销案件少,难以有效遏制泰国对华反倾销行为。因此,我国应加强中泰两国在发展战略与规划方面的对接合作,最大限度减少甚至避免反倾销争端;扩大对泰国钢铁产业的高质量直接投资,有效规避泰国对华钢铁制品反倾销壁垒;深入研究和充分利用泰国价格承诺规则,降低泰国对华反倾销执行率;适时适度发挥我国对泰国反倾销的威慑效能,阻遏和降低泰国对华反倾销的动因和频度;积极争取泰国对华暂停征收反倾销税,减少泰国对华反倾销造成的福利损失。
The economic and trade relations between China and Thailand are becoming increasingly close,but Thailand's frequent anti-dumping against China has seriously affected the construction of the comprehensive strategic partnership and a community with a shared future between China and Thailand,as well as the economic and trade relations between China and other ASEAN member countries and even the entire ASEAN.Resolving Thailand's anti-dumping against China is of great significance for seeking solutions to anti-dumping issues under the framework of China-ASEAN Free Trade Area and even RCEP.Based on 30 cases of Thailand's anti-dumping against China(cases of Thailand's anti-dumping against China Taiwan,China Hong Kong,and China Macao are excluded)from 1995 to 2021,the authors analyze the current situation and reasons of Thailand's antidumping against China.It is found that:China has become the primary target country of Thailand's anti-dumping;the steel industry and products are most frequently involved in Thailand's anti-dumping against China;both the implementation rate and duty rate of Thailand's anti-dumping against China is high;and under the background of COVID-19,Thailand's anti-dumping cases against China has increased,and the suspension of Thailand's anti-dumping duties on China has been implemented.The main reasons for Thailand's frequent anti-dumping against China are:firstly,Thailand has implemented long-term trade protection policies to promote industrialization process and get rid of the middle-income trap;secondly,China is Thailand's largest import source country,and the trade mode between the two countries has increasingly shifted to intra-industry trade;thirdly,the steel industry is a relatively inferior industry that Thailand is striving to protect,while China is the main source of Thailand's imported steel products;fourthly,Chinese companies neglect to use price undertaking as an effective measure to actively respond to anti-dumping lawsuits,resulting in a high implementation rate of Thailand's anti-dump
