摘要
在社会主义核心价值观融入释法说理的制度框架之下,法院正在司法裁判过程中有意识地践行价值引领,但案件识别不清、说理实质性不强、要素运用不恰、文书引领作用不够等问题仍然存在。对此,可以在现有制度的基础上,通过精准界定应当强化释法说理的重点案件,深入把握社会主义核心价值观的运用方式,积极完善相关配套机制的建立健全等方式构设完善路径。
Under the institutional framework of socialist core values into interpretation of law and reasoning,courts are consciously practicing value guidance in the process of judicial judgment,but the issue still exist,such as unclear identification of cases,weak substantive reasoning,improper use of elements,and insufficient leading role of documents.In this regard,based on the existing system,it can be constructed by accurately defining the key cases that should be further interpreted and explained,deeply grasping the application of socialist core values,actively improving the establishment and improvement of relevant supporting mechanisms and so on.
