摘要
网络短视频平台为电信网络诈骗犯罪提供了新的环境,网络短视频平台电信网络诈骗犯罪呈现出链条延长性、犯罪数额累积性、犯罪手段隐匿性、犯罪对象广泛性等新特征。上述新特征与犯罪机会紧密相连,应借鉴新机会理论中的犯罪模式理论、理性选择理论与日常活动理论来探寻网络短视频平台电信网络诈骗犯罪的生成机制。针对网络短视频平台电信网络诈骗犯罪,应在减少新环境中电信网络诈骗犯罪机会的前提下,强化网络短视频平台反电信网络诈骗犯罪的责任,提高电信网络诈骗犯罪主体的犯罪成本与风险,营造安全规范的网络短视频平台环境。
The online short video platform provides a new environment for telecommunication network fraud crimes,and the online short video platform telecommunication fraud crimes present new features such as chain prolongation,accumulation of crime amount,concealment of crime means and wide range of crime objects.The above new features are closely related to criminal opportunities,and the crime model theory,rational choice theory and daily activity theory from the new opportunity theory should be drawn upon to explore the generation mechanism of telecommunication fraud crimes on the online short video platform.The responsibility of the online short video platform against telecommunication fraud crime should be strengthened under the premise of reducing the opportunity of telecommunication fraud crime in the new environment,increasing the crime cost and risk of telecommunication fraud crime subjects,and creating a safe and standardized online short video platform environment.
