摘要
对于应当如何实施《行政处罚法》第49条规定的“依法快速处罚”,行政机关拥有一定的方式选择空间。法理层面,可为实施快速处罚之理由提供解释的行政紧急权力理论与行政处罚的预防目的观,在能否以省略程序之方式实施快速处罚的问题上存在分歧。实践层面,行政机关通过行使程序性裁量权、调整部分内部程序步骤等简化程序的方式提升处罚实施效率,但为保护当事人程序权利及防止程序目的落空,这类方式应受限制。同时,实践中存在对程序环节适用范围作出临时性调整,进而于个案中省略程序的做法。今后如肯定此类做法之正当性,须对实现临时性调整的方式加以规范,建议采用事前立法的方式对作出临时性调整的主体、条件、期限等作出明确规定。
When it comes to how to give the"prompt punishment under the law"stipulated in Article 49 of the Administrative Penalty Law,administrative agencies have various options.From the jurisprudential perspective,the theory of administrative emergency power that can provide explanations for the reasons of giving prompt punishment and the preventive purpose of administrative punishment differ in whether to give prompt punishment by means of omitting procedures.From the perspective of practice,administrative organs attempt to improve the efficiency of giving punishment by using procedural discretion and simplifying such procedures as the readjustment of some internal procedural formalities.However,in order to protect the related persons’procedural rights and prevent procedural objectives from failure,such methods should be restricted.Meanwhile,in practice,procedural formalities have chances of being temporarily readjusted and certain procedures may be omitted in some cases.If the legitimacy of such practices is proved positive in the future,administrative organs should standardize the methodology of making temporary readjustments.A suggestion is made that the law should be made in advance to clearly define the subjects,conditions,term and the like for making such temporary adjustments.
