摘要
检察机关实质性化解行政争议是检察机关推动法治现代化的使命所在,有效实施法律的要求所在,履行行政检察监督的职能所在。检察机关按照办案环节和流程,在行政争议实质性化解中承担着程序启动的主导者、沟通协调的推动者、磋商化解的主持者的角色。总结司法实践有益经验,构建行政争议实质性化解制度,需要进一步明确案件适用范围,坚持以适当性和必要性原则综合选择最匹配案件化解的方式,并从管理、素质、机制三个方面完善检察人员业绩考核、提升检察队伍专业素养、强化内外协作办案机制等配套措施。
The participation of procuratorial organs in the substantive resolution of administrative disputes is the mission of procuratorial organs to promote the modernization of the rule of law,the requirement of implementing laws and policies and the function of administrative procuratorial supervision.According to the links and processes of handling cases,the procuratorial organ plays the role of the leader of procedure initiation,the promoter of communication and coordination,and the host of consultation and resolution in the substantive resolution of administrative disputes.To sum up the beneficial experience of judicial practice and build a substantive resolution system of administrative disputes of procuratorial organs,we need to further clarify the scope of application of cases,adhere to the principle of appropriateness and necessity to comprehensively select the most suitable way to resolve cases,and improve the performance assessment of procuratorial personnel from three aspects of management,quality,and mechanism,enhance the professional quality of the procuratorial team,and strengthen internal and external cooperation in case handling mechanisms.
