摘要
《欧盟运行条约》第207条第1款要求所有欧盟机构在进行对外经贸合作的过程中,必须落实《欧洲联盟条约》第21条规定的宪法性原则。自《里斯本条约》生效以来,欧盟委员会将维护国际劳工组织颁布的《工作权利宣言》中的核心劳工权与“持续不懈努力批准”基本劳工权公约作为其在对外经贸合作中落实可持续发展原则的基本要求。然而,与欧盟和其他经济体缔结的全面投资协定或自由贸易协定的文本内容相比,《中欧全面投资协定》草案未特别提及核心劳工权的具体内容,也未强制要求缔约双方必须批准第87、98号国际劳工组织公约,从而增加了《中欧全面投资协定》草案违反欧盟一级立法的风险。为此,可以借助欧盟—韩国专家小组的部分意见和欧盟第2/15号意见的部分内容,通过条约解释的途径,承认《中欧全面投资协定》草案第4.3.5条赋予核心劳工权约束力的法律地位,从而化解这一风险。这样的解释也符合欧盟第2/15号意见确立的劳工权条款的功能。
In accordance to the Art.207(1)of the Functioning Treaty of European Union,all the EU institutions must guarantee the fundamental values enshrined in the Art.21 of the Treaty of European Union in the common foreign commercial activities.Since the Lisbon Treaty comes into effect,protecting the core labor standards provided by the ILO Declaration on Fundamental Principles and Rights at Work and making the sustained and continued efforts to ratify the ILO fundamental labor conventions are the basic obligations,imposed by the European Commission,as to implement the principle of sustainability.However,differing from bilateral commercial treaties concluded by EU and its other state partners,neither the draft of Comprehensive Agreement on Investment between EU and China(CAI)demonstrates the full contents of ILO core labor standards,nor does it impose a mandate obligation for the bilateral parties to ratify the ILO Convention No.87 and No.98.Therefore,this difference may increase the risk of violating EU primary law.To solve this problem,EU-Korea panel expert decision and EU opinion 2/15 could be emphasized as effective solutions to get rid of the challenge,for that Art.4.3.5,though the interpretive techniques,grants the binding effects of ILO core labor standards under the CAI.The outcome of interpretation keeps in line with the EU Opinion 2/15 in terms of the function of labor provisions as well.
