摘要
近年来,将劳工条款纳入国际经贸协定的做法日益普遍。2021年1月,欧盟经贸协定下劳工争端解决第一案即欧韩劳工分歧处理案的专家组报告公布。该报告重点探讨了《欧韩贸易协定》中劳工规则的边界以及缔约国承担的劳工保护义务,这为解读我国与欧盟缔结的《中欧全面投资协定》中的劳工规则提供了重要参考。相较于《欧韩贸易协定》《中欧全面投资协定》中的劳工保护要求更为具体细致。就此,建议我国在劳工争端解决方面,合理使用该投资协定下的分歧处理机制,并建立劳工问题的预处理程序;对于劳工保护实体规则,进一步明确协定下劳工条款的范围,与此同时不断提高自身劳工保护水平,积极向国际劳工标准靠拢。
In recent years,it has become increasingly common to include labour provisions in trade and investment agreements.In January 2021,the panel report on the fi rst labour dispute under a trade agreement of the EU—the EU-Korea Labour Case was published.The report focused on the boundaries of labour rules in the EU-Korea Trade Agreement and the labour protection obligations undertaken by the contracting parties thereunder,which provides an important reference for the interpretation of the labour provisions under the EU-China Comprehensive Agreement on Investment.Compared to the EU-Korea Free Trade Agreement,the EU-China Comprehensive Agreement on Investment is characterized by the more stringent labour protection requirements.In this regard,in conjunction with the analysis of the Panel Reoport on the EU-Korea Labour Case,it is recommended that China make reasonable use of the Mechanism to Address Dif ferences under the Agreement and establish a pre-processing procedure for labour issues;while for the issue of substantive rules on labour proctection,the scope of labour rules under the Agreement should be further clarifi ed and China should constantly improve the level of labour protection and actively move towards international labour standards.
