摘要
诚信是一个社会得以平稳运行的重要道德基础。围绕个体诚信的培养,传统中国儒家和法家分别提出了“以徳促信”和“以法促信”的主张,其在现实生活环境中则分别对应于名声(誉)感和奖惩措施两种机制。采用社会学经验分析手段考察两种诚信培养机制在当代中国社会的适用情况,发现:(1)个体的名声(誉)感和对于法院的信任度都显著提升个体诚信,因此儒法两家的主张都能够在当代中国社会得到经验支持。(2)给定变量测量下,相比于法家的“以法促信”,儒家的“以徳促信”在提升个体诚信感方面展现了更强的效果。(3)一种机制的实现会对另外一种机制形成“挤出”效应。
Integrity as a foundational moral value is the bedrock upon which a healthy society is built.Confucianism and Legalist respectively make suggestions for maintaining integrity:through virtue and through law,which in real life are the sense of honor,and reward and punishment.The study has the following results:(1)The sense of honor and trust in courts both help to maintain integrity,which can be seen as the empirical evidence of Confucianism and Legalist;(2)Compared with Legalist,Confucianism has proven to be more effective;(3)The two schools of thought exclude each other,that is,the implementation of one crowds out the other.
