摘要
随着国家监察体制改革趋于深化,我国职务犯罪监察调查的证据规则逐渐确立。《监察法》《监察法实施条例》中,对职务犯罪监察调查的证据规则进行了分散式规定。相较于刑事诉讼法及其司法解释,监察调查的证据规则尚不完善。当前对监察证据规则的研究较为初步,尚未形成理论体系。在对《监察法》《监察法实施条例》的相关内容进行法教义学研究的基础上,提出以证据能力规则与证明力规则两分来构建职务犯罪监察调查的证据规则理论体系,以期破除监察与司法衔接中的相关难题。其中,非法监察证据排除规则系监察证据能力规则的核心;而监察证据证明力规则包括对传来监察证据的限制规则、实物监察证据的鉴真规则、监察证据印证规则与口供补强规则等。
With the deepening of the reform of the national supervision system,the evidence rules for the supervisory investigation of duty-related crimes in China have been gradually established.The evidence rules for the supervisory investigation of duty-related crimes are decentralized in the Supervision Law and the Regulations for the Implementation of the Supervision Law.Compared with the Criminal Procedure Law and its judicial interpretation,the evidence rules of supervisory investigation are not perfect.At present,the research on the rules of supervisory evidence is relatively preliminary,and the theoretical system has not yet been formed.On the basis of the jurisprudential study of the relevant contents of the Supervision Law and the Regulations on the Implementation of the Supervision Law,this paper proposes to construct the theoretical system of the evidence rules for the supervisory investigation of duty-related crimes based on the rules of the capability of evidence and the rules of probative power with an aim to breaking the relevant problems in the connection between supervision and judicature.Among them,the exclusionary rule of illegal supervisory evidence is the core of the rule of capability of supervisory evidence,while the rule of probative power of supervisory evidence includes the restriction rule of supervisory evidence,the truth identification rule of physical supervisory evidence,the verification rule of supervisory evidence and the reinforcement rule of oral confession.
