摘要
公安机关调查权介入高空抛坠物侵权案件具有重要性,有利于及时查清侵权人,维护各方合法权益,强化法律威慑,凸显警示预防作用,发挥公安机关作用,完善综合治理体系。公安机关调查权介入高空抛坠物侵权案件具有正当性,符合民事法律规范之精神,体现警察公共原则的要求,契合案件性质变化的需要。公安机关调查权介入高空抛坠物侵权案件在调查权的法律属性、调查结论的证据归类、公安机关在案件中的诉讼地位等问题尚有待深入探讨。可从明晰公安机关调查权介入的原则、程序和保障等方面完善公安机关介入高空抛坠物侵权案件的路径。
