摘要
宅基地“三权分置”的内涵在于通过对宅基地使用权的去身份化以盘活闲置宅基地,实现农村宅基地的财产价值。农户资格权是突破宅基地使用权流转限制、实现宅基地财产价值的关键,应当将农户资格权界定为成员权。农村集体经济组织成员可以基于成员身份而享有宅基地取得权、无偿使用权、征收补偿权、退出权及退出补偿权等。应将农户资格权予以法治化,实现宅基地身份属性与财产属性的平衡。
The connotation of the“Separation of Three Rights”is to revitalize the idle homestead land and realize the property value of rural homestead land through deidentification of the use right of homestead land.The farmers qualification rights are the key to breaking through the restriction of transferring the right to use homestead and realizing the property value of homestead land,and the farmers qualification rights should be defined as the membership right.The members of rural collective economic organizations can enjoy the right to acquire residential bases,the right to use them without compensation,the right to expropriate and compensate,the right to withdraw and the right to withdraw compensation based on their membership in rural collective economic organizations.The farmers qualification rights should be legalized to achieve a balance between the identity attributes and property attributes of residential bases.
