摘要
本文结合宅基地制度的变迁历程,论述了宅基地产权的产权结构和性质归属,并对照中央的宅基地"三权分置"改革要求解析了其实施路径。本文认为宅基地"三权"的剩余权法的认知方法,不利于宅基地问题的解决,这也是试点地区难以形成有效制度经验的原因所在。中央提出的宅基地"三权分置"改革为解决宅基地问题提供了新的产权工具,基层在改革实践中应注重使用新工具解决产权制度层面的基本性问题。农村集体宅基地的均等化福利分配制度,以及在工业化进程中产生的宅基地使用权身份限制、建设用地指标权受限等一系列制度变迁,是宅基地问题的根源所在。本文提出了包括宅基地有偿使用、量化土地发展权、产权市场交易三方面建议的系统化解决方案。
This paper discusses the structure and nature of the property right of the homestead according to the changing process of the homestead system,and then according to the requirements of the central government’s"Three Rights Separation"reform,this paper analyzes the implementation path of the reform.This paper holds that the cognitive method of residual right is not conducive to the solution of the problem,this is also the reason why it is difficult to form effective institutional experience in pilot areas.The"Three Rights Separation"reform of homestead proposed by the central government provides a new property right tool for solving the problem of homestead,the basic level government should use this new tool to solve the fundamental problems of property rights system.The welfare distribution system of rural homestead,as well as a series of institutional changes in the subsequent industrialization process,such as the identity restriction of homestead use right and the limitation of construction land index right,are the root causes of homestead problems.This paper puts forward a systematic solution including paid use of homestead,quantification of land development right and property right market transaction.
