摘要
市场监管是我国社会主义市场经济条件下的政府基本职能,也是建设高标准市场体系的重要支撑。中国独特而丰富的市场监管改革实践,需要具有自主的市场监管知识体系来加以诠释和指导。依据知识体系构建的一般原理,结合中国市场监管丰富实践和国外市场监管理论,本文指出了中国市场监管现代化道路跟其它4种不同类型国家的差异,总结了中国市场监管现代化面临七大情境因素,从微观监管认知、中观监管理论和宏观监管哲学提出了中国自主的市场监管知识体系的分析框架,对中国社会主义市场经济体制下的中央—地方、政府—市场以及国家—社会3个方面的重大特征进行了归纳,回答了中国市场监管的一系列重大问题,为下一阶段继续深入推进中国自主的市场监管知识体系提出了总体的研究方向。最后,本文总结了未来需要推进的基础性研究和工作,从而为推进中国市场监管治理体系与能力现代化,讲好中国监管故事,让中国监管实践更好地为充实和丰富人类社会的监管知识体系建设做出贡献。
Market regulation has been defined as a fundamental governmental function in China’s socialist market economy context which can provide important support for its high-standard market economy system. It is urgently needed for China to build its independent knowledge system to understand and guide its unique and rich market regulatory reform. In terms of basic principles of knowledge system building, China’s rich market regulation experience and general governmental regulation theories, this article compares the differences among China and other four types of countries’ market regulatory modernization patterns and summarizes seven contextual features of China’s market regulation reform. It raises an analytical framework of China’s independent knowledge system on market regulation which includes regulatory cognition in micro-level, regulatory theory in meso-level and regulatory philosophy in macro-level. This framework generalizes China’s socialist market economy and its regulatory system from central-local relation, government-market connection and state-society relation, providing convincing answers for a series of substantial questions in China’s market regulation reform, indicating general research direction for its independent knowledge system building in market regulation for next step. Finally, it proposes a range of fundamental work needed in the future to build China’s independent knowledge system on market regulation. All those effort and research can help to promote China’s market regulatory modernization, share China’s regulatory reform story by good communication and devote to enriching market regulatory knowledge system building for mankind.
