摘要
城市养犬是当今城市治理的一大难题,亦是文明行为促进中的重点治理对象。对各城市的养犬管理条例进行文本分析可以发现,我国对养犬在监管理念上侧重限制和管理、在监管主体上单一且排他、在监管措施上单一且重罚,同时还存在执法主体不统一,法律责任规定的梯度、程序、内容差异大等问题。因此,应当改变监管理念,将“限制养犬”改为“规范养犬”,在权责明确的条件下,形成多元化的治理主体,创新监管治理手段,完善顶层设计,细化监管对象与责任,以实现治理成效的最大化。
Raising dogs in cities is a great problem in urban governance and it is also a key governance object in the promotion of civilized behaviors. Through the text analysis of the urban dog management regulations, it can be found that there are some common problems, i.e., focusing on restriction and management in the supervision concept, single and exclusive supervision subject, single and severe penalty in supervision measures. Besides, the law enforcement subjects are inconsistent,and the gradients, procedures and contents of legal liability provisions are greatly different.Therefore, it is necessary to change the supervision concept, i.e. change "restricting dog keeping" to "regulating dog keeping". With the prerequisite of clear rights and responsibilities, diversified governance subjects should be formed, regulatory governance means should be innovated,top-level governance should be improved, and regulatory objects and responsibilities should be refined to maximize the effectiveness of governance.
