摘要
社区矫正的惩罚性在应然与实然层面存在显著差异,而这一现象并非我国社区矫正制度所独有,域外实证研究同样证明社区行刑存在惩罚性悖论,其制度实践并不符合理论预设。本文梳理了不同时间和空间下有关社区行刑的概念及其正当化理由,并对其进行了有效性、公正性和周全性的检验。在此基础上,通过对已有实证研究的总结,解析了域外社区行刑惩罚性悖论的现实缘由,并通过比较研究分析了我国社区矫正实践中存在的共性与差异因素。本文发现,犯罪控制的整体目标仍然嵌入在原有的评价体制之中,社会公众所期待的仍然是可以通过显性数据证明有效性的安全感,犯罪率、再犯率和行刑效率对社会治理状况的标识作用被放大。因此,社区行刑的目标设定的实现除了需要理论本身的自洽性之外,更需要提高政府、司法机关和公众对有关罪犯矫正和犯罪控制理论创新的接纳程度。
The punitiveness of community corrections is significantly different from what it should be,and this phenomenon is not unique to the community correction system in China.Empirical studies abroad have also shown that there is a punitive paradox in the community execution of penalties,and its institutional practice does not conform to the theoretical presuppositions.In this article,the concept of community execution of penalties and its justification are examined in different times and spaces,and its validity,fairness and thoroughness are also tested.On this basis,through a summary of the existing empirical studies,we analyze the realistic causes of the paradox of punishment in the community execution of penalties in foreign countries,and analyze the common and different factors existing in China’s community correction practice through a comparative analysis.It has been found that the overall goal of crime control is still embedded in the original evaluation system,and what the public expects is still a sense of security that can be proven effective by the explicit data.Moreover,the impact of crime rate,recidivism rate,and execution efficiency as indicators of social governance is amplified.Therefore,in addition to the self-consistency of the theory itself,the realization of the goal setting of the community execution of penalties requires an increased acceptance of theoretical innovations in offender rehabilitation and crime control by the government,judicial organs,and the public.
