摘要
欧洲法院近期驳回波兰起诉废止《欧盟版权指令》第17条的请求,意味着欧盟在网络版权领域对于“避风港制度”的变革突破得以最终确立。《欧盟版权指令》设置了全新的网络版权侵权责任规则,明确在线内容分享平台作为“在线内容提供者”而非“网络服务提供者”的属性认定,并要求其在传统的“避风港制度”之外主动与版权人合作,运用技术手段承担事前的侵权识别与屏蔽义务。当下,面对“避风港制度”在我国网络版权侵权治理领域的适用困境,可以在批判借鉴欧盟改革经验的基础上,通过加强版权人与平台间的合作,完善平台版权保护注意义务体系和推动版权保护新技术的应用来加以应对。
The Court of Justice of the European Union ruled to reject Poland’s request to abolish Article 17 of the directive 2019/790 on copyright and related rights in the Digital Single Market,which means that the EU’s breakthrough in the“safe harbor rules”in the field of online copyright was finally maintained.The directive 2019/790 sets a new online copyright infringement rule,clarifies the attribute identification of UGC content sharing platform as“online content provider”rather than“Internet service provider”,and requires the platform to use content recognition technology to prevent infringements in advance.To deal with the current dilemma in the application of the“Safe Harbor Rules”in the field of copyright infringement governance on platforms,we can improve the platform’s copyright protection duty of care system and promote copyright protection by strengthening the cooperation between copyright owners and platforms on the basis of criticizing and learning from the experience of EU reform.
