摘要
融媒体时代背景下,以算法技术对网络版权进行治理俨然已成为各国版权立法探讨的重点。欧盟率先以“国家法律”的方式对避风港规则进行重塑,将网络平台的版权内容过滤设定为一项法定义务。然而,该法定过滤义务与禁止普遍审查原则相冲突,且过滤标准的晦暗不明还导致了过度封锁合法上传内容,以及限制言论自由的风险。通过对欧盟版权内容过滤的上述困境与最新回应进行深度剖析,可窥见平台注意义务的发展方向。本文认为,我国应审慎赋予网络平台版权过滤义务,选择以市场“自治规则”为主导的网络平台版权内容过滤的改革路径,以注意义务兼容特殊审查义务,并秉持“合法使用优先”原则与“明显侵权”的审慎审查标准。
Under the background of media convergence era,the governance of network copyright by algorithm technology has become the focus of copyright legislation in various countries.The EU has taken the lead in reshaping safe harbor rule in the form of"national law",making the filtering of copyrighted content on online platforms a statutory obligation.However,the statutory filtering obligation conflicts with the principle of prohibiting general monitoring,and the opacity of the filtering standards also leads to the risk of excessive blocking of legally uploaded content and limiting freedom of expression.Through the in-depth analysis of the above dilemma and the latest response of copyright content filtering in the EU,we can see the development trends of online platform duty of care requirements.This paper argues that China should be cautious in entrusting online platforms with copyright filtering obligations and can choose the reform path of copyright filtering content of network platform led by market"self-regulation"to the duty of care.Finally,China also can integrate the platform’s duty of care with the specific monitoring obligation in legislation,and uphold the principle of"protecting legitimate uploads is a top priority"and the prudential review standard of"obvious infringement".
