摘要
美国宪法学家罗伯特·卡弗的“法与叙事”论述,为理解法律叙事与法律权威之间的关系提供了一个有启发性的视角。结合中华民国初期法统政治的经验来看,一部宪法权威的确立和维护,需要具有守护宪法之自觉的叙事者提供两种叙事,一种是关于政权与宪法之正当性起源的叙事,另一种是关于宪法的效力如何在时间中绵延的叙事,重点在于解释宪法实施过程之中出现的种种断裂和例外现象。中华民国初期的法统政治在这两个方面都出现了巨大的争议和困境,导致无论是1912年《中华民国临时约法》法统还是1914年《中华民国约法》法统,都不能够凝聚足够的权威。对民初法统政治的探讨有助于研究者进一步思考宪法史叙事的制度功能,从而增强对于自身的制度角色自觉。
The “Nomos and Narrative” theory, proposed by the American constitutional theorist Robert Cover, provides an inspiring perspective to rethink the relationship between legal narrative and legal authority. The constitutional politics of the early Republic of China revealed that the establishment and maintenance of the authority of a specific constitution depends upon two types of narratives: one is the founding epic narrating the origins of the current government and constitution;the other is the narrative exploring how the validity of the constitution extended in the time, with a focus on the disruption and exceptions in the application of the constitution. The constitutional politics of the early Republic of China produced enormous controversies and dilemmas on the two aspects, resulting in the weak authority of the 1912 Constitution(together with its succeeding constitutional documents) and the 1914 Constitution. The exploration of the early republican constitutional politics from the “Nomos and Narrative” perspective could help researchers understand the institutional functions of the constitutional narrative, as well as their own institutional roles in the writing of the constitutional history.
