摘要
标准必要专利(SEP)作为链接标准、专利、技术、创新的重要手段,在国际竞争中起到了举足轻重的作用。本文收集并整理发达国家与我国近十年标准必要专利领域政策性文件修订过程与征求意见,从时间与区域两个维度分析找出发达国家与我国标准必要专利生态建设对提升国家竞争力关系的不同竞争态势。通过分析发现,美国将标准必要专利作为推动国家经济发展的重要方式,也是提升美国国际竞争力的重要手段。英国通过标准必要专利建立国际知识新框架,从而支撑英国创新战略。欧洲通过标准必要专利支撑欧盟经济复苏,在保障欧洲各国利益的同时进一步提升竞争优势。我国在标准必要专利领域不断出台相关文件,以构建我国创新联动新体系。分析发达国家标准必要专利生态建设为提升我国经济竞争新格局具有借鉴意义。
Standard essential patents(SEP) play a pivotal role in international competition as an important means of linking standards, patents, technologies and innovations. This paper collects and sorts out the revision process and opinion solicitation of policy documents in the fi eld of standard essential patents between developed countries and China in the past ten years. It identifi es the different competitive situations between developed countries and China in the construction of standard essential patents to enhance national competitiveness from the perspectives of time dimension and regional dimension. Through the analysis, it is found that the United States regards standard essential patents as an important way to promote its national economic development and an important means to enhance its international competitiveness.The UK underpins its innovation strategy by establishing a new international framework of knowledge through standard essential patents. Europe supports its economic recovery through standard essential patents, further enhancing its competitive advantage while safeguarding the interests of European countries. China has continuously issued relevant documents in the fi eld of standard essential patents to build a new system of innovation linkage in China. Analyzing the ecological construction of standard essential patents in developed countries provides reference for enhancing the new pattern of economic competition in China.
