摘要
警察法上的战时概念,从报纸期刊到警务实践,其外延在规范演进中有扩大化的趋势。需要从认定标准的维度,根据法律保留和法律优先原则对“战时”概念予以厘定和规制。用《突发事件应对法》中因特别重大突发事件进入的“应急状态”取代“战时状态”,明确规定“战时”应包括特别重大疫情等突发重大公共卫生事件。
From newspapers and periodicals to police practice,the extension of the concept of"wartime"in police law tends to expand in the evolution of norms.It is necessary to define and regulate the concept of"wartime"from the dimension of identification standards,according to the principle of legal reservation and legal priority.The Emergency Response Law provides that"emergency"replace"wartime"in terms of extremely serious emergencies and clearly specifies that"wartime"should include major public health emergencies such as particularly serious epidemics.
