摘要
帮助信息网络犯罪活动罪当前有异化为信息网络犯罪之“口袋罪”的倾向,在实践中呈现出扩张适用。这表现为“明知”认定标准的模糊化、“利用信息网络实施犯罪”要件的矮化、“帮助”行为的扩大化以及“情节严重”的虚置化。司法扩张适用不仅导致将应认定为相关联犯罪的共犯情况不当认定为本罪,而且与“少捕慎诉慎押”的刑事司法政策不符。单以帮助犯正犯化说、量刑规则说、积量构罪说解释帮助信息网络犯罪活动罪的性质均存在疑问。立足于本罪的规范保护目的与构造,帮助信息网络犯罪活动罪具有补充功能、强化功能与纠偏功能。以此为指引,可以从理论上提出限缩本罪适用的方法,以及明确本罪与诈骗罪的共犯、掩饰、隐瞒犯罪所得、犯罪所得收益罪的界限,规范本罪在司法中的适用。
The crime of assisting information network criminal activities currently has the tendency to alienate into the “pocket crime” of information network crime, and in practice, it shows an expansion of application. This is manifested in the blurring of the standard of “knowledge”, the dwarfing of the element of “using information network to commit a crime”, the expansion of the act of “helping” and the fictionalization of “aggravating circumstances”. The application of judicial expansion not only leads to the inappropriate identification of the accomplice as a related crime, but also is inconsistent with the criminal justice policy of “less arrest, careful prosecution and careful remand”. The nature of the crime of assisting information network criminal activities is problematic, based on the purpose and structure of this crime, the crime of assisting information network criminal activities has a complementary function, strengthening function and corrective function. With this as a guide, it is possible to theoretically propose ways to limit the application of this crime, as well as to clarify the boundaries between this crime and the crime of complicity in fraud, the crime of covering up or concealing proceeds of a crime or proceeds from a crime, and to regulate the application of this crime in justice.
