摘要
流域兼具自然属性与社会属性,应综合自然、政治、经济、文化等多种因素进行治理。基于对地方多元化实践的现状分析,流域环境司法治理存在生态整体性与行政地方性难以衔接、治理主体间协同不足、流域环境司法协同实践内容模糊等问题。以此为参照,有必要实现从“传统环境司法治理”到“流域环境司法治理”的观念转变,本文认为流域环境司法治理的关键在协同,应遵循整体性、协同性、融合与平衡的治理理念指导流域司法工作。在此基础上,重构全流域环境司法的机关协同治理机制,创新流域环境司法的制度保障机制,完善流域环境司法的运行协同机制,以期为我国流域环境司法协同治理机制的路径完善提供思路。
River basins have both natural and social attributes, and should be governed by various factors such as nature, politics, economy, and culture. Based on the analysis of the status quo of local diversified practices, environmental judicial governance of river basins have problems such as the difficulty of linking the ecological integrity and the administrative locality, the insufficient coordination of various agencies in judicial work, and the vague content of the judicial collaborative practice of river basins environment. So it is necessary to realize the concept change from “traditional environmental judicial governance” to “river basins environmental judicial governance”. It is believed that the key to watershed environmental judicial governance lies in coordination. The governance concept of integrity, synergy, integration and balance should be followed to guide the judicial work of river basins. On this basis, it is important to reconstruct the coordinated governance mechanism of environmental justice agencies in the whole river basin, innovate the system guarantee mechanism of environmental justice and improve the operation coordination mechanism of environmental justice in the river basin. Then it can provide ideas for the improvement of the coordinated governance mechanism of the river basin environmental justice in China.
