协同学视角下京津冀公共法律服务协同机制研究 被引量:2

摘要 公共法律服务协同发展是落实京津冀协同发展战略的重要保障,也关系到区域法治一体化建设的水平。故此,建立京津冀公共法律服务协同机制尤为重要。协同学与京津冀公共法律服务协同机制具有契合性,可为理解京津冀公共法律服务协同机制奠定分析框架。在协同学视角下,京津冀公共法律服务协同机制显现出理念同步效应、主体互补效应及行动统一效应。运用协同学的参量原理,可以识别支配协同机制运行的序参量是行政管辖权,而引导协同机制运行的控制参量是区域合作协议。在行政管辖权和区域合作协议的共同作用下,应构建关系协同、政策协同及行为协同的京津冀公共法律服务协同机制。 The coordinated development of public legal services is an important guarantee for the implementation of the Coordinated Development Strategy of Beijing-Tianjin-Hebei Region,and is related to the level of regional legal integration.Therefore,it is particularly important to establish a public legal service synergy mechanism of Beijing-Tianjin-Hebei Region.Synergetics is consistent with the public legal service synergy mechanism of Beijing-Tianjin-Hebei Region,which lays an analytical framework for understanding the public legal service synergy mechanism of Beijing-Tianjin-Hebei Region.From the perspective of Synergetics,the public legal service synergy mechanism of Beijing-Tianjin-Hebei Region shows the synchronous effect of ideas,the complementary effect of subjects and the unified effect of actions.Using the parametric principle of Synergetics,it can be recognized that the order parameter governing the operation of the synergy mechanism is the administrative jurisdiction,while the control parameter guiding the operation of the synergy mechanism is the regional cooperation agreement.Under the joint action of administrative jurisdiction and regional cooperation agreements,the public legal service synergy mechanism of Beijing-Tianjin-Hebei region is constructed,which includes relationship coordination,policy coordination and behavior coordination.
