摘要
电子送达默示同意规则源于互联网法院提高电子送达适用率的实践需要,它突出强调诉讼效率价值,隐含有效性替代的实现方式。电子送达默示同意规则扩大适用可能造成当事人在不知道涉诉的情况下即被缺席审判的危险。为保障当事人程序权益,电子送达默示同意规则的适用应当受到必要的限制。作为的默示才是认定默示同意的一般标准。不反对即同意只能作为默示同意规则的例外。在默示同意中,法院应当在电子送达通知中充分告知受送达人其享有选择是否适用电子送达的权利,同意的表达方式以及同意之后需要承担的义务和责任,不同意的表达方式及其法律责任。法院发出诉讼文书和送达通知之后,应当给予受送达人合理的期限查阅和作出是否同意电子送达的选择。
The implied consent rule for electronic service originates from the practical needs of internet courts to improve the application rate of electronic service,which highlights the value of litigation efficiency and the implementation way of implied validity substitution.The expanded application of the electronic service implied consent rule may create the risk of parties being tried in absentia without knowledge of the lawsuit involved.In order to protect the procedural rights and interests of the parties,the application of the electronic service implied consent rule should be subject to necessary restrictions.The act tacit declaration is the general criterion for identifying implied consent,While Consent equating with no objection can only be used as an exception to the implied consent rule.In the implied consent,the court should fully inform the recipient in the electronic service notice that he has the right to choose whether to apply electronic service,the way of expressing consent,the obligations and responsibilities that need to be assumed after consent,and the way of expressing disagreement and its legal responsibilities.After the court issues the litigation documents and the notice of service,it shall give the recipient a reasonable period of time to consult and make a choice of whether to agree to electronic service.
