摘要
目前教师职业违规行为的处理存在诸多问题,究其根本,主要在于针对教师职业违规行为的处理没有统一的高位阶处理规范,故亟待制定一部统一的高位阶行政法规或部门规章对实践中频发的教师职业违规行为处理进行指导。在立法的过程中,需要注意六个问题:一是教师及教师职业行为的范围界定;二是教师职业违规行为的认定及规定方式的确定;三是明确教师职业违规行为处理措施的类型与适用;四是设立教师职业违规行为监督委员会;五是保障教师职业违规行为处理程序的规范性与高效性;六是健全教师权利救济的多元化渠道。
At present,there are many problems in handling teachers’professional violations,the root of which lies in the lack of a unified high-level standand for handling teachers’professional violations.Therefore,it is urgent to formulate a unified high-level administrative regulation or departmental rule to guide the handling of teachers’professional violations that occur frequently in practice.In the process of legislation,the following six issues need to be paid attention to:the first is to define the scope of teachers and teachers’professional behaviors;the second is to identify teachers’professional violations and determine the prescribed methods;the third is to clarify the types and application of the measures to handle violations;the fourth is to establish a committee to supervise teachers’professional violations;the fifth is to ensure the standardization and efficiency of handling procedures;and the sixth is to improve the diversified channels for teachers’relief.
