摘要
教师资格取消是教师资格制度的重要组成部分。当前,我国教育法律规范中缺乏对教师资格取消的具体规定,导致教师资格制度体系不完整、教师权利救济不到位等问题。通过法理分析,将教师资格取消分为自始无效、自然取消和违法取消三种情形。针对我国当前教师资格取消面临的教师资格制度与教师职业制度相混淆、定期注册制度不完善、相关规定缺乏体系性等问题,通过拆分《中华人民共和国教师法》第十四条,规定教师资格的吊销和撤销情形、完善教师资格定期注册制度,以及增加教师资格取消的相关救济条款等诸多措施,以规范教师资格取消为重心,完善我国教师资格制度。
Cancellation of teacher qualification is an important part of the teacher qualification system.At present,the lack of specific provisions on the cancellation of teacher qualification in China's education laws and regulations has caused problems such as incomplete teacher qualification system and insufficient teacher rights relief.Through legal analysis,the cancellation of teacher qualification is divided into three situations:initial invalidity,natural cancellation and illegal cancellation.There are some problems in the cancellation of teacher qualification such as the confusion between the teacher qualification system and the teacher professional system,the imperfect regular registration system,and the lack of systematicness.We should improve our teacher qualification system by splitting article 14 of the Teacher Law,stipulating the revocation and the cancellation of teacher qualification,improving the regular registration system of teacher qualification and increasing the relief clauses for cancellation of teacher qualification.
