摘要
东北亚海洋废物处置具有复杂性、广泛性与跨界性等特征,需要加强区域合作治理。现有涉海洋废物处置的国际公约以及东北亚区域内相关双边与多边协定和文件,为东北亚海洋废物处置合作治理提供了一定的法理依据。但由于东北亚区域内有关海洋废物处置合作治理缺少专门协定,只是在相关条款中有所涉及,再加上区域内各国国内法授权的差异,造成相关立法及合作机制存在一定缺陷,从而影响有关合作开展及其效果。东北亚相关国家应与国际社会一道,努力完善有关海洋废物处置的国际法规则体系,以便更好地为区域内海洋废物处置合作治理提供有效的制度供给。在这个过程中,中国要积极参与东北亚有关海洋废物处置合作治理的规则建设,为维护东北亚海洋废物处置的良好秩序贡献中国方案。
The disposal of marine wastes in Northeast Asia is characterized by complexity,universality and cross-border,so it is necessary to strengthen regional cooperation and governance.The existing international conventions on marine waste disposal and relevant bilateral and multilateral agreements,plans and other relevant cooperation provisions in the Northeast Asia region provide a certain legal basis for the cooperative governance of marine waste disposal in Northeast Asia.However,due to the lack of special agreements on the cooperative governance of marine waste disposal in Northeast Asia,which are only covered in relevant provisions,and the differences in the domestic law authorization of countries in the region,there are certain defects in relevant legislation and cooperation mechanisms,which affect the development and effectiveness of relevant cooperation.In this regard,the relevant countries in Northeast Asia should work with the international community to improve the international legal system on marine waste disposal,so as to better provide effective institutional supply for the cooperative governance of marine waste disposal in the region.In this process,China should actively participate in the construction of laws and regulations on the cooperative governance of marine waste disposal in Northeast Asia,and contribute to the Chinese plan for maintaining the good order of marine waste disposal in Northeast Asia.
