国土空间规划时代地质环境规划的法律定位

摘要 地质环境作为生态环境的重要组成部分,其与资源和环境安全息息相关,是我国生态文明建设的重要影响因素。通过对我国地质环境领域法规与规划编制情况进行梳理,得出了当前地质环境规划领域立法不完善、规划的编制不普遍、规划的法律地位亟待提升的结论。为了加强对地质环境的保护,强化地质环境的基础地位,结合国土空间规划的时代背景,有必要通过提高地质环境规划的法律定位,完善地质环境规划体系,构建地质环境规划法律保障体系,强化规划的空间表达能力等措施,加强地质环境规划与国土空间规划的对接,为推进生态文明建设提供地质安全保障。 The geological environment as an important component of ecological environment, which is closely related to the resource and environmental safety, is an important influence factor in the construction of ecological civilization in our country. Through analyzing the status quo of geological environment planning laws and regulations, it was concluded that the legislation of geological environment planning was not perfect, the planning was not universal and the legal status of planning should be improved urgently. In order to strengthen the protection of geological environment, strengthen the basis of the geological environment status, in combination with the era background of the national spatial planning, it is necessary to enhance the legal position of geological environment planning, perfect the system of the geological environment planning and construction of geological environmental planning law guarantee system, strengthen the planning of space expression ability, enhancing geological environment planning and national spatial planning of docking, to promote the construction of ecological civilization to provide geological security guarantee.
