摘要
家庭教育问题是导致未成年人滑向违法犯罪深渊的重要原因之一。近年来,家庭教育法律体系日益完善,包括《家庭教育促进法》在内的多部法律明确了家庭教育指导的重要意义和基本要求,但在运行中逐渐呈现出一系列问题。本文尝试立足检察视阈,从司法实践中未成年人犯罪背后的家庭教育问题出发,梳理国家干预家庭教育的历史沿革,解析罪错未成年人家庭教育干预的现状和困境,提出罪错未成年人家庭教育的完善路径,以期唤醒监护人的责任意识,发挥国家干预的有效作用,强化未成年人保护,预防和减少未成年人违法犯罪。
Family education problems are often an important cause of minors slipping into delinquency.Since 2020,several laws,such as the Family Education Promotion Law,have clarified the importance and basic requirements of family education guidance,and the legal system of family education has become increasingly complete,but a series of problems have gradually emerged in its implementation.Based on the procuratorial perspective and in light of the family education behind crimes committed by minors in judicial practice,this paper attempts to sort out the history of state intervention in family education,analyze the current situation and challenges related to family education for intervention for delinquent minors,and proposes a path for improving family education for delinquent minors.The aim of this study is to help raise guardians’awareness of their responsibilities,bring into play the effective role of state intervention,strengthen the protection of minors and prevent as well as reduce juvenile delinquency.
