摘要
公安机关行政执法行为在客观上能够为民事诉讼提供证据,文章从研究公安机关行政执法为民事诉讼提供材料的外延出发,分析其在民事诉讼中作为证据使用的法律依据和理论依据,说明部分材料在民事诉讼中已经取得合法地位,在理论和实践研究的基础上呼吁对尚未通过民事诉讼制度加以甄别的行政执法提供的材料亦应给予充分的重视。在公安机关行政执法提供的材料被民事诉讼接纳的情况下,从证据能力、行政行为的公定力和公权与私权角度探讨这些材料在民事诉讼中的效力应如何进行认定。
The administrative law enforcement actions of public security organs can objectively provide evidence for civil proceedings,but the status and role of such evidence in civil proceedings need to be studied.This paper starts from the study of the extension of the materials provided by the administrative law enforcement of public security organs for civil litigation,to find the legal and theoretical basis for the emergence of certain types of materials in civil litigation,so as to explain that some materials have obtained legal status in civil litigation.And according to practice and theory,it is inevitable that the materials provided by the administrative law enforcement of public security organs can be applied in civil proceedings.The objective system needs and the parties’demand for proof make it necessary to face up to the role of these materials in civil proceedings.In the case that the materials provided by the administrative law enforcement of the public security organs are accepted by civil proceedings,this paper further discusses how to judge the effectiveness of these materials in civil proceedings from the perspective of evidence capacity,the public power of administrative acts,public rights and private rights,so as to provide directional demonstration for the correct application of civil proceedings and the formulation of specific legal norms,in order to complete the theoretical framework of administrative law enforcement materials provided by public security organs in civil litigation.
