摘要
本研究概述了中国种子知识产权保护和监管体系的现状以及中国种子管理工作存在的问题,结合现行的种子监管法律法规,对中国种子监管体系和管理工作在品种知识产权、种子监管部门管理、种子市场规模化和种子检测水平等方面进行了分析,提出相应的强化种业知识产权、健全种子监管部门执法体系、扶持地方种子机构规模化生产和提高种子检测水平的对策,以期为中国种子科技创新和知识产权保护和监管体系提供参考。
This study summarized the current situation of China’s seed intellectual property protection and supervision system,as well as the existing problems in China’s seed management.Combined with the current seed supervision laws and regulations,it analyzed China’s seed supervision system and management work in terms of variety intellectual property rights,seed supervision department management,seed market scale and seed testing level,This paper puts forward corresponding countermeasures to strengthen seed industry intellectual property rights,improve law enforcement system of seed supervision departments,support large-scale production of local seed institutions and improve seed testing level,so as to provide reference for China’s seed scientific and technological innovation and intellectual property protection and supervision system.
