摘要
2022年是《家庭教育促进法》落地“元年”,该法准确定位了实施家庭教育的责任主体,明确指引了家庭教育的方向,规定了提供家庭教育指导服务的有关政府部门和机构的具体职责,强调必要时对触及底线的家庭教育行为进行干预,为未成年人拥有良好家庭教育环境提供了法律保障。该法的出台预示着家庭教育不再仅仅是家庭内部的事情,更需要全社会共同协作来为家长赋能,协同推进家庭教育指导服务体系建设,优化我国的家庭教育生态。本文以全国九省的家庭教育指导服务开展现状为基,对比《家庭教育促进法》的具体要求,分析了“实然”与“应然”的差距,提出了缩减差距的解决对策,希冀助推我国家庭教育指导服务体系建设,为法律落地提供可行参考。
In 2022, Family Education Promotion Law of China(hereinafter ’the Law’) was launched in China for the first time.In the Law, the subject of liability in practicing family education is precisely assigned, the orientation of family education is clearly instructed, and the specific duties of relevant departments on providing family education guidance services is formulated. The Law underlies necessary interventions in family education behaviors that violates the provisions of law, with the aim of ensuring a sound family education environment to the minors. With the Law being promulgated, family education is no longer merely a family matter.It is an affair that requires social collaboration that energize the parents. Relevant governmental departments, universities, schools,communities, and any other relevant social public services shall work together to achieve the implementation of laws, by jointly promoting the construction of family education guidance service system and optimizing the family education ecology in China. In this essay, the gap between legal requirements and practice situations is analyzed based on the status quo of family education guidance services in nine provinces of China, and solutions for narrowing down the gap are proposed with an expectation of impelling the construction of family education guidance service system, as well as providing practical reference for implementation of laws.
