雇员弹性工作请求权的法律保障及启示——基于英美立法的考察 被引量:2

The Legal Protection and Enlightenment of Employees’ Right to Request for Flexible Working Arrangements:Based on the Investigation of British and American Law

摘要 为推动弹性工作制的实施,在英美国家,开始以立法方式赋予雇员“请求进行弹性工作”的权利。从规范现状来看,“请求权立法”通常包括请求主体、权利的行使步骤、请求事项、请求权的阻却、权利救济等要素。雇员弹性工作请求权的实施得益于特定的外部及内部条件。雇员弹性工作请求权具有重要价值,体现在有利于弹性工作制的推广、有利于雇员平衡工作和家庭照顾义务、架构起劳资沟通及协商机制、提供了劳动关系规制的策略选择。然而,对程序本身的过度关注会导致对实体正义背离,依赖于个人权利的行使,易忽视集体劳动关系调整的独特作用。在借鉴英美国家制度经验的基础上,文章认为我国弹性工作制的未来发展应引入工作与家庭平衡的考量因素、注重实体和程序平衡并强化劳资集体协商。 In order to promote the implementation of flexible work system in the United Kingdom and the United States, employees have been given the right to request for flexible working arrangements. From the normative status quo, “request legislation” usually includes the subject of the request, the steps of exercising the right, the matters of the claim, the obstruction of the claim, the right relief and other elements. The implementation of employees’ flexible work request benefits from specific external and internal conditions. Employees’ flexible work request has important value, which is reflected in the promotion of flexible work system, the balance of work and family care obligations of employees, the construction of labor capital communication and negotiation mechanism, and the strategic choice of employment relations regulation. However, paying too much attention to the procedure itself will lead to the deviation from substantive justice, which depends on the exercise of individual rights, and it is easy to ignore the unique role of collective labor relations adjustment. Based on the institutional experience of Britain and the US, the future development of flexible work system in China should introduce the consideration of work family balance, pay attention to substantive and procedural equity, and strengthen collective bargaining.
