摘要
随着共享经济与灵活就业的发展,出现了专门为共享经济平台与平台就业人员提供证照代办、身份核验、业务分包、收入结算等综合性服务的“服务平台”。在服务平台场景下,平台就业人员的劳动权益保障又呈现出一些特有的新问题,突出体现在:企业用户借服务平台掩盖劳动关系,“多角用工”模式导致确定维权对象困难以及“劳动管理”的认定缺乏明确标准。作为保障服务平台就业人员劳动权益的对策,需要服务平台落实签约履约管理责任,监管机关整备用工关系认定指南,行业协会、工会乃至科研机构、主流媒体等社会各界共同参与,共建平台领域健康良好的用工秩序。
With the development of the sharing economy and flexible employment,a“service platform”has emerged that provides comprehensive services such as license agency,identity verification,business subcontracting,and income settlement for sharing economy platforms and platform employees.In the service platform scenario,the protection of labor rights and interests of platform employees presents some unique new problems,which are prominently reflected in:enterprise users use the service platform to cover up labor relations,the“multi angle employment”model makes it difficult to identify employers,and the lack of identification of“labor management”clear standards.As a countermeasure to protect the labor rights and interests of employees on the service platform,it is necessary for the service platform to implement the management responsibility for contract performance,the regulatory authorities to develop guidelines for the identification of labor relations,and industry associations,trade unions,scientific research institutions,mainstream media and other sectors of society to participate in the establishment of a benign employment order in the platform field.
