中院助理到基层法院入额的模式探索与机制优化——以后员额制背景下法官选任多元化为视角

摘要 中级法院法官助理到基层法院入额是员额制改革深入推进的一项重要改革探索,有利于打通中基层法院的人员流动通道,满足中级法院助理入额需求与优化基层法院人才供给。从此项改革探索的实际情况看,存在运行率低、入额标准不统一、方法路径有偏差、配套措施不到位等突出问题,原因主要在于改革顶层设计不足、基层法院岗位吸引力低、基层法院法官内心抵触、中级法院态度消极等。有必要从改革设计的逻辑前提、经验借鉴和司法工具论三个层面进行理论解析,为中级法院助理到基层法院入额机制设计提供方法指引。应当关注法院整体利益提升、人力资源配置优化、初任法官养成更优等三个方面的目标,在宏观层面实现改革设计的“指导理念、规范架构和实证范式”三维提升。在中观和微观层面,则应当回归价值本源、完善顶层设计、强化大数据研究,实现中级法院助理锻炼、基层法院入额遴选、基层法院审判保障的三阶段流程再造。同时,保持司法改革相关政策的适度弹性,在实践中丰富改革的内容,实现各项改革措施的协同效应。 The admission of judge assistants from Intermediate People’s Court to Basic Peopl’s Court to be judges is an important reform exploration under the deepening of quota system of judge,which is conducive to opening up the flow channel of personnel between Intermediate People’s Court and Basic People’s Court,satisfying the admission demand of assistants in Intermediate People’s Court and optimizing talent supply in Basic People’s Court.From the actual situation of this reform exploration,there are outstanding problems such as low and irregular operation probability,inconsistent entry standards,method path deviation and inadequate supporting system measures.The reason is that the top-level design of the reform is insufficient,low appeal of Basic People’s Court positions,assistants of Basic People’s Court has a resistance to the’sinking’to be judges,and Intermediate People’s Court has a negative attitude towards the’sinking’to be judges.Therefore,it is necessary to analyze the reform mechanism from three aspects:logic premise,experience reference and judicial tool theory,so as to provide methodological guidance for the design of the admission of judge assistants from Intermediate People’s Court to Basic People’s Court to be judges.We should pay attention to the three goals of improving the overall interests of the court,optimizing the allocation of human resources,and cultivating new judges.What’s more,the three-dimensional improvement of’guiding concept,normative framework and empirical paradigm’of reform design should be realized from a macro perspective.From the meso and micro perspective,it is important to return to the source of value,perfect top-level design and strengthen big data research,in order to realize the three-stage process reengineering of assistants training,selection quota,and trial guarantee of Basic People’s Court.At the same time,we should maintain the appropriate flexibility of the judicial reform related policies,enrich the content of reform in practice and
