摘要
海南自由贸易港是改革试验田和制度创新高地,建立容错纠错机制具有重要意义,能够契合海南自由贸易港建设的时代背景,有利于营造“敢干事、干成事”的环境,也符合全面从严治党和建立责任型政府的要求。在愈加强调全面依法治国的今天,建立法治化的容错纠错机制极为必要,因为建立在法治基础上的容错纠错机制才更具正当性和稳定性,更能够为实践中的改革创新提供指引和保障。海南建立法治化的容错纠错机制,应解决好以下四个方面的问题:一是如何选择容错纠错机制的法治化载体,二是如何选择容错纠错的法治化模式,三是如何科学厘清容错的范围,四是如何设置合理的容错和纠错程序。
Hainan Free Trade Port is an experimental field of reform and a highland of institutional innovation.It is of great significance to establish a fault-tolerant and error-correcting mechanism,which conforms to the historical background of the construction of Hainan Free Trade port,is conducive to creating an environment of"dare to do things and get things done",and also meets the requirements of comprehensively governing the Party with strict discipline and establishing a responsible government.Today,with the increasing emphasis on the comprehensive rule of law,it is extremely necessary to establish a fault tolerance and correction mechanism based on the rule of law,because the fault tolerance and correction mechanism based on the rule of law is more legitimate and stable,and can provide guidance and guarantee for reform and innovation in practice.How to establish the mechanism of error tolerance and correction based on the rule of law in Hainan should solve the following four problems:first,how to choose the carrier of the mechanism of error tolerance and correction based on the rule of law;second,how to choose the mode of error tolerance and correction based on the rule of law;third,how to scientifically clarify the scope of error tolerance;fourth,how to set up reasonable error tolerance and error correction procedures.
