摘要
陶瓷非遗作为文化瑰宝和人类智慧结晶,其法律保护是必要和迫切的,非遗保护法和知识产权法在陶瓷非遗保护中有着不可或缺的作用。由于非遗保护法的原则性和指引性,知识产权法保护与陶瓷非遗的诸多客体又存在许多冲突,导致法律适用的困难。这就需要对陶瓷非遗保护的手段和方式进行一定程度的创新,对其进行多层次的法律保护,使知识产权法能够良好适用于陶瓷非遗保护,充分发挥非遗保护法的作用。景德镇作为千年瓷都,也一直在寻求陶瓷非遗的保护路径,本文旨在通过分析陶瓷非遗保护的法律与运用现状,寻求适合景德镇陶瓷非遗保护的策略。
The intangible cultural heritage, as cultural treasures and crystallization of wisdom, demands right and urgent legal protection. For this, the relevant protection laws and intellectual property laws are indispensable. Due to the principles and guidance of the intangible cultural heritage protection law, there exist many conflicts concerning the law of intellectual property and some objects of ceramic intangible cultural heritage, leading to great difficulty in application of the law, which demands innovation to the means of the protection activities, for example, to exercise multi-level protection, so as to ensure a better application and a fuller play of the law to the intangible cultural heritage. In short, Jingdezhen, as the porcelain capital for thousands of years, has been looking for ways to protect ceramic intangible cultural heritage, so this paper aims to find suitable strategies for the protection of ceramic intangible cultural heritage in this city by analyzing the law and application status of it here.
