摘要
改革开放以来,中国农业立法加速发展,农业法律体系已初步建成,但不足之处仍然显著。基于伦理与法律之间深层次的内在联系,中国农业立法的发展同样也离不开农业伦理的评价和价值支撑。基于此,在农业伦理视域下,对中国农业立法的现状和问题进行研究,以期不断完善中国的农业立法体系和法治建设,通过法律制度的引导和规范,以农业资源的合理利用和农业生态环境的有效保护为目标,改革现有的生产模式,发展高效、低耗及低污染的现代农业,破除城乡二元结构的壁垒,建设繁荣而美丽的新农村,实现农业农村经济效益、社会效益与生态效益统一的高效持续发展。
Since the reform and opening up,China's agricultural legislation has accelerated development,and the agricultural legal system has been preliminarily completed,but the deficiencies are still significant.Based on the deep-seated internal relationship between ethics and law,the development of agricultural legislation in China is also inseparable from the evaluation and value support of agricultural ethics.Based on this,under the perspective of agricultural ethics,the current situation and problems of agricultural legislation in china were studied,so as to continuously improve China's agricultural legislation system and the construction of the rule of law.Through the guidance and regulation of the legal system,with the rational use of agricultural resources and the effective protection of agricultural ecological environment as the goal,reform the existing production mode,develop high-efficiency,low-consumption and low-polluting modern agriculture,break down the barriers of the urban-rural dual structure,build a prosperous and beautiful new countryside,and realize the efficient and sustainable development of the unity of economic,social and ecological benefits of agricultural and rural areas.
