摘要
以家暴案件为例,采用实验探讨受害者情绪状态与受伤程度对其可信度的影响与机制。结果发现,在家暴案件中,相较于平静的受害者,对悲伤受害者的可信度显著更高,相较于轻伤的受害者,对重伤受害者的可信度显著更高;受害者的悲伤符合观察者对其作为受害者角色的期望,引发了对他们的同情,进而能够提升对其的可信度。司法实践中要理性评价受害者的悲伤情绪,既要尊重受害者表达悲伤情绪的权利,也要规避其对诉讼价值实现可能产生的不利影响。
Taking domestic violence cases as an example,using experiments to explore the influential mechanism of victims’emotional state and injury degree on their credibility.Results showed that in domestic violence cases,the credibility of sad victims is significantly higher than that of calm victims,and the credibility of seriously injured victims is significantly higher than that of slightly injured victims;The victim’s sadness is in line with the observer’s expectations of his role as a victim,leading to sympathy for them,which can enhance their credibility.In judicial practice,the victims’sadness should be rationally evaluated,we should not only respect the victims’right to express sadness,but also avoid its possible adverse impact on the realization of litigation value.
