摘要
为适应新冠疫情防控需要,国外很多图书馆采用受控数字借阅这一远程借阅模式满足读者的借阅需求。这种新兴模式平衡了读者和版权人的利益,但当前在中国尚不属于法定的合理使用情形,影响了该模式在图书馆的应用。首先结合合理使用的相关理论分析受控数字借阅模式的合法性,然后结合该模式的价值分析图书馆采纳该模式的必要性,最后提出版权视角下构建受控数字借阅模式的几点建议:在立法中将该模式纳入合理使用范畴;图书馆设定该模式中借阅图书的类型,并采取技术措施严格控制该模式的“受控”环节。
In order to meet the needs of the prevention and control of the COVID-19, many foreign libraries have adopted the remote lending model of controlled digital lending to meet the lending needs of readers. This new model balances the interests of readers and copyright owners, but it is not currently a legal fair use in China, which affects the application of this model in libraries. Firstly, the legality of the controlled digital lending mode is analyzed in combination with the relevant theories of fair use, and then the necessity for the library to adopt the mode is analyzed in combination with the value of the mode. Finally, it puts forward several suggestions from the perspective of copyright when building the controlled digital lending mode: in the legislation, this model is included in the category of fair use;the library sets the types of books lent in this model, and takes technical measures to strictly control the “controlled” links of this model.
