摘要
近年来,网络赌博犯罪盘踞境外,与面向非法市场的包网公司、第四方支付等黑灰产业合作,由过去单一聚合型组织形式演变为多个环节衔接的链条式犯罪结构,隐蔽性强、时空跨度广、侦查难发现。赌资交易是网络赌博行为发生的关键环节,也是赌博集团获取非法牟利的来源途径,犯罪团伙通常将赌客充值伪装为正常的“商业交易”,利用电子支付渠道实施洗钱和“返水”。以归集赌资的第四方支付、“跑分”平台作为开展资金流侦查的起点,在“案-资金-信息-人”侦查模式下,通过分析、研判网络赌博犯罪的洗钱特征,摸清重点账户的资金来源与去向,结合资金链路中伴随的电子信息流,最终落查涉案人员身份并定位犯罪窝点。
In recent years,online gambling crime has extended beyond national borders,cooperating with black-gray industries such as network companies and the fourth party payment for illegal market.The crime of online gambling has evolved from a single aggregation-type organization form to a chain crime structure with multiple links and participation,which has the characteristics of strong concealment,wide space-time span and difficulty to detect.Gambling capital transaction is the key link of online gambling and also the main source of gambling groups to obtain illegal profits.Criminal gangs usually disguise recharge as normal“commercial transactions”and use electronic payment channels to implement money laundering and recycling.This study mainly took the fourth party payment and“running points”platform as the starting point for fund flow investigation.Under the“case-fund-information-person”mode,the source and destination of funds in key account were found out by analyzing the money laundering characteristics of online gambling crime.And combining with the accompanying electronic information flow in the capital link,the identity of the criminals and crime dens were eventually located.
