摘要
建设用地指标市场化改革在实践中广泛进行,基于建设用地指标行政配置僵化和市场在土地资源配置中作用彰显的现实,需要对其法律属性加以重释。目前,学界围绕建设用地指标法律属性这一基础性理论命题的论证,“私权说”和“公权说”皆有之,呈现出混乱与片面的态势,亟需正本清源。从社会现实出发,建设用地指标既是国家重要的土地调控工具,既具有公权力的外在表现,又表现出私权利外观。其法律属性需要对二者兼容,将其定位于公私权融合属性,在理念上符合公私权合作理念,在规范上贴合政策法规的精神,在实践上切合现实发展需求。并以此为依据对土地用途管制权等公权力设置合理限制,对土地发展权的私权属性予以立法规范。
The marketization reform of construction land index is widely carried out in practice.Based on the rigid administrative allocation of construction land index and the obvious role of market in land resource allocation,it is necessary to reinterpret its legal attribute.At present,the academic circle has both the "private right theory" and the "public right theory" on the basis of the basic theoretical proposition of the legal property of construction land index,which presents a chaotic and one-sided situation which needs to be clarified.Starting from the social reality,the construction land index is an important land control tool of the state,with the external manifestation of public power,and also participates in the market transaction,showing the appearance of private rights.Its legal attribute needs to be compatible with the two,and it should be positioned as the attribute of public-private right integration conforms to the concept of public-private right cooperation in concept,conforms to the spirit of policies and regulations in standard,and meets the practical development needs in practice.Based on this,the author sets reasonable limits on the public power,such as the land use control right,and legislates and standardizes the private property of the land development right.
