摘要
附条件不起诉制度的实际效果与社会力量参与度紧密相关。在涉罪未成年人的矫治工作中,全面的社会力量参与,能够补位家庭教育的缺失,与司法机关的教育挽救工作相辅相成,有利于未成年人实现自我赋能,回归社会。实践中,受限于资源匮乏、法律政策不明确、支持体系不完善等困难,社会力量在附条件不起诉制度适用过程中尚未能充分发挥作用,通过转介机制引入优质社会资源,丰富帮教模式,形成规模效应,在社会关注、关心、关怀下建立区域乃至全国范围的涉罪未成年人帮教网络,有利于实现该制度设立的初衷。
The real effects of conditional non-prosecution system are closely linked with the participation of social forces.In the correction of offence-related juveniles,the comprehensive participation of social forces can compensate for the lack of family education,complements judicial agencies’ education and rescue work,and is conducive to juveniles’ self-improvement and return to society.In practice,owing to the lack of resources,unclear laws and policies,imperfect support system and other difficulties,social forces have not yet played a full role in the application of conditional non-prosecution system.By the means of the referral mechanism,high-quality social resources are introduced to enrich the correction and education model,thus having immeasurable effects.With social supports and cares the regional and even national assistance and education network for offence-related juveniles has been established,which is conducive to the realization of the original intention of the system.
